Terms & Conditions of Booking

TST Engineering Services Ltd

1. Introduction

These Terms & Conditions govern all bookings, purchases, subscriptions and professional services provided by TST Engineering Services Ltd ("TST", "we", "our" or "us").

By booking any service, purchasing any product, subscribing to any membership or using our website, you agree to be bound by these Terms & Conditions.

2. Our Services

TST Engineering Services Ltd provides professional maritime education and consultancy services including, but not limited to:

• MCA Engineering Oral Examination Preparation

• Oral Preparation by TST Engineering Services Ltd

• Marine Engineering Consultancy

• E-Learning Courses

• Professional Maritime Training

• Digital Learning Resources

• Engineering Publications

• Downloadable Manuals

• Technical Reports

• SPECTRE™ Professional Learning Platform

• Subscription Learning Packages

• On-site Engineering Consultancy

3. Booking Confirmation

A booking becomes confirmed once:

• Full payment has been received (unless otherwise agreed in writing); or

• Written confirmation has been issued by TST Engineering Services Ltd, this may be email confirmation or google meets appointment link.

We reserve the right to refuse or cancel any booking where necessary.

4. Course Fees

All prices are displayed in Pounds Sterling (£) unless otherwise stated.

Prices may change without prior notice; however, confirmed bookings will remain at the agreed price.

5. Payment Terms

Payment must be received before training, consultancy services or access to digital products is provided unless otherwise agreed in writing.

Accepted payment methods include:

• Debit/Credit Card

• Bank Transfer

• Secure Online Payment Providers

Failure to make payment may result in cancellation of your booking or suspension of access to online services.

6. Cancellations & Refunds

Training, Oral Preparation & Consultancy Sessions

For instructor-led training, Oral Preparation sessions and consultancy appointments:

• Cancellation requests received more than 72 hours before the scheduled commencement may be considered for a refund or transfer at the discretion of TST Engineering Services Ltd.

• No refunds will be issued for cancellations made within 72 hours of the scheduled commencement of any booked session.

Transfers within 72 hours are entirely at the discretion of TST Engineering Services Ltd and may be subject to an administration fee.

E-Learning & Digital Products

Due to the immediate availability and accessibility of digital content:

No refunds will be provided for:

• E-Learning Courses

• Digital Downloads

• Engineering Manuals

• Digital Publications

• Learning Packs

• Quiz Packages

• Flash Cards

• Infographics

• AI Learning Resources

• SPECTRE™ subscriptions

• Any downloadable or streamed digital product

Once access has been granted or digital content has been downloaded, the purchase becomes non-refundable.

Nothing within these Terms affects your statutory rights under applicable UK consumer legislation.

Paywall Learning Packs

Where a refund is approved for a Paywall Learning Pack prior to digital access being activated, an administration and processing fee of £100.00 will be deducted from the refundable amount.

Once access has been activated, the purchase becomes non-refundable.

Bank Transfer Payments

Where a refund is approved for a payment originally made by Bank Transfer, an administration fee of £75.00 will be deducted from the refund to cover banking, administration and processing costs.

No-Show Policy

Failure to attend a booked training session, Oral Preparation appointment or online meeting without prior notification shall be treated as a No-Show.

No refund, credit or transfer will be provided.

A new booking will require payment of the applicable service fee.

Cancellation by TST Engineering Services Ltd

Should TST Engineering Services Ltd cancel a course or consultancy appointment due to operational requirements, instructor illness or circumstances beyond our reasonable control, customers will be offered either:

• A full refund; or

• Transfer to an alternative available date.

TST Engineering Services Ltd shall not be liable for any consequential costs or losses arising from such cancellation.

7. On-Site Consultancy Services

Bookings for an on-site consultant provided by TST Engineering Services Ltd require a 30% non-refundable deposit to secure the booking and reserve consultant availability.

The remaining balance must be paid in accordance with the agreed quotation or invoice.

Where a client cancels an on-site consultancy booking within 72 hours of the scheduled commencement date, no refund of the deposit or any payments received will be made.

If TST Engineering Services Ltd is unable to provide the agreed consultant due to unforeseen operational circumstances, clients should contact us immediately. We will make every reasonable effort to provide an alternative consultant or agree a mutually acceptable revised date.

8. Online Learning

Access to online learning platforms is licensed solely to the registered user.

Users must not:

• Share accounts or login credentials.

• Copy or distribute course materials.

• Record videos or online sessions.

• Reproduce manuals or publications.

• Upload TST content to third-party websites.

• Attempt to bypass subscription or paywall protections.

Unauthorised use may result in immediate suspension or permanent termination of access without refund.

9. Intellectual Property

All training materials, manuals, engineering reports, publications, videos, quizzes, flash cards, infographics, engineering drawings, software, website content, branding and digital learning resources remain the exclusive intellectual property of TST Engineering Services Ltd unless otherwise stated.

No material may be copied, reproduced, distributed, modified, sold, shared or commercially exploited without prior written permission.

10. Certificates

Certificates are issued where applicable following successful completion of the relevant course or assessment requirements.

TST Engineering Services Ltd reserves the right to withhold certification where course requirements have not been satisfactorily completed.

11. Consultancy Services

Engineering advice and consultancy services are provided using professional judgement based upon information supplied at the time.

Clients remain responsible for all operational decisions, statutory compliance and implementation of any recommendations.

12. Examination Preparation

Our courses and Oral Preparation services are designed to prepare candidates for professional maritime examinations.

Whilst every effort is made to maximise a candidate's opportunity for success, TST Engineering Services Ltd cannot guarantee examination success, certification or employment.

Final examination outcomes remain entirely at the discretion of the relevant awarding authority, including the UK Maritime and Coastguard Agency (MCA).

13. Candidate Responsibilities

All candidates agree to:

• Provide accurate booking information.

• Attend punctually.

• Behave professionally.

• Follow instructor guidance.

• Respect other delegates and TST staff.

TST Engineering Services Ltd reserves the right to remove any participant whose behaviour is considered disruptive, abusive or inappropriate.

No refund will be issued in such circumstances.

14. Website & Digital Services

Users agree not to:

• Attempt unauthorised access to TST systems.

• Circumvent website security.

• Upload malicious software.

• Misuse downloadable content.

• Share subscription accounts.

• Copy or redistribute subscription materials.

Access may be suspended or permanently revoked where misuse is identified.

15. Limitation of Liability

To the fullest extent permitted by law, TST Engineering Services Ltd shall not be liable for:

• Examination failure.

• Employment decisions.

• Loss of earnings.

• Business interruption.

• Indirect or consequential losses.

• Technical failures outside our reasonable control.

Nothing within these Terms excludes liability for death, personal injury caused by negligence or any liability that cannot legally be excluded under English law.

16. Force Majeure

TST Engineering Services Ltd shall not be responsible for delays or cancellations arising from circumstances beyond our reasonable control, including but not limited to severe weather, industrial action, government restrictions, internet outages, power failures, pandemics, natural disasters or other force majeure events.

17. Privacy

Personal information is processed in accordance with our published Privacy Policy and applicable UK data protection legislation.

Should you be dissatisfied with any aspect of our services, please contact us in the first instance.

We aim to acknowledge complaints within two working days and provide a substantive response as soon as reasonably practicable.

19. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
